Plan for a new Aldi store in Brighouse that would create more jobs has been put on hold again after a rival developer appealed a High Court ruling.
The development on Birds Royd Lane had been given the go-ahead at the High Court after they won a legal challenge over developer Younger Homes Northern Ltd.
However, the developer has opposed the decision and a case will be heard at the Appeal Court in London.
Mike Clarke, Property Director at Aldi, said: “Younger Homes has applied to the Court of Appeal to oppose the Aldi store development in Brighouse. This is a two stage process, the first is leave to appeal (i.e. gaining permission to appeal the original judgement), and the second could be a formal hearing at the Court of Appeal.
“As Younger Homes has already had its’ claims dismissed on four different occasions and has been defeated at each stage of the process, Aldi believes taking this matter to the Court of Appeal represents yet another step which will cause further delays to the development.
“Aldi is disappointed at potential further delays to the project, although we are strongly optimistic about delivering a new store.”
